Court Order questions…
Who can get a Court Order?
Anyone can apply for a Court Order but it will depend on the type of order and circumstances as to whether or not anything gets issued.
How to get a Court Order?
To proceed, you’ll need to complete the appropriate court form, which depends on the type of order you are seeking. All forms can be downloaded from Justice.gov.uk. For most family law matters, the relevant form is the C100. However, a comprehensive list of forms is available on the website, and all family-related forms can be accessed in one place.
Most forms come with guidance leaflets or checklists to help you complete them accurately. It’s important to follow these instructions carefully, as forms that are incorrectly completed may not be accepted.
Once your form is complete, submit it to your local county or family court. Filing a form typically involves a fee, which varies depending on the type of application. For instance, a debt claim usually costs around £70, while a family order application may cost up to £200. You can confirm the exact fee with your local court.
What is a Court Order?
A court order is a formal directive issued by a judge (or panel of judges) that outlines the legal relationships between the parties involved in a hearing, trial, appeal, or other court proceedings. It mandates or permits specific actions to be taken by one or more parties in the case.
